OVERVIEW

This website is operated by Habituel ("we," "us," "our"). By visiting our site or purchasing from us, you agree to these Terms of Service and the policies referenced in them, including our Refund Policy, Shipping Policy, and Privacy Policy. If you do not agree, do not use the site or place an order.

We may update these Terms at any time. The version posted at the time of your purchase governs that purchase. Continued use of the site after changes means you accept the changes.

Our store is hosted on Shopify Inc.

SECTION 1 - ELIGIBILITY AND ACCOUNT ACCURACY

You must be the age of majority in your jurisdiction to purchase. You agree to provide accurate, current name, email, shipping, billing, and payment information, and to keep it updated. We are not responsible for orders that fail or go astray because of information you entered incorrectly.

You may only use payment methods you are authorized to use. Placing an order with someone else's payment card without authorization is fraud and will be reported.

SECTION 2 - ORDERS AND BILLING

All prices are in USD and may change without notice. We may refuse or cancel any order at our discretion, including orders that appear fraudulent, automated, placed by resellers, or that exceed quantity limits. If we cancel a paid order, we refund it.

Charges from us appear on your card statement as HABITUEL.

Order confirmation is sent to the email you provide at checkout. It is your responsibility to review it. If anything is wrong, email support@habituel.com immediately.

SECTION 3 - MODIFYING OR CANCELING AN ORDER

Email support@habituel.com as soon as possible. We can modify or cancel an order only if a packing slip has not yet been created. Once fulfillment begins, the order ships and our Refund Policy applies instead.

You are responsible for avoiding duplicate orders. Review your cart before checkout. Duplicate orders follow the standard Refund Policy.

SECTION 4 - SUBSCRIPTION TERMS

By subscribing, you authorize recurring charges to your payment method at the price and frequency selected during checkout. These terms are disclosed at checkout and you give express consent to them when you place your first subscription order. Charges continue until your subscription is canceled in accordance with this section.

How to cancel. You can cancel anytime, with no fees, in either of two ways:

1. Account portal (instant). Log in through the Manage Subscription link in the footer of every page and in every order email. Portal cancellation is immediate and takes about one minute. This is the same online method you used to sign up.
2. Email (requires verification). Email support@habituel.com from the email address on your account. To protect customers from unauthorized changes, we verify identity before changing any subscription. We will reply asking you to confirm: full name, order number, email address, shipping address, billing address, and the last four digits of the payment card. An email cancellation takes effect only when we send written confirmation that the subscription is canceled. A request without completed verification remains pending and does not stop billing.

Timing. A completed cancellation stops all future charges and shipments. To avoid an upcoming charge, complete your cancellation before that billing date. Charges processed before a cancellation is completed are valid and are not refundable on the basis of the later cancellation.

Billing reminders. We send a payment reminder email before each recurring charge to the email on your account. Keeping that email current is your responsibility.

Identity protection. We have experienced third parties attempting to cancel or alter subscriptions that were not theirs. Verification exists to protect you. We will not cancel, modify, or discuss a subscription with anyone who cannot verify the account.

Skipping and pausing. You can skip a delivery or reschedule through the account portal at any time before the billing date.

We may adjust subscription pricing or terms with advance email notice. If you do not accept a change, cancel before your next billing date.

SECTION 5 - PRODUCTS

Product images may differ slightly from the physical product. We may limit quantities, discontinue products, or correct pricing and description errors at any time, including canceling orders placed under a listing error (with refund).

SECTION 6 - RECORDS AND DISPUTED CHARGES

We retain order records, checkout consent records, IP and device data, delivery confirmations, account portal activity, and all support correspondence.

If you believe a charge is in error, contact support@habituel.com first. Most billing issues are resolved within one business day. If a charge is disputed with a card issuer, we submit our records in response. We contest disputes we believe to be invalid, including disputes of subscription charges billed before a cancellation was completed under Section 4. We reserve the right to refuse future service to accounts associated with invalid disputes.

SECTION 7 - PRODUCT USE AND MEDICAL DISCLAIMER

Our products are intended for healthy adults and are not intended to diagnose, treat, cure, or prevent any disease. Statements on our website and packaging have not been evaluated by the FDA.

You are solely responsible for determining whether any ingredient may cause an adverse reaction. Consult a qualified healthcare provider before use, especially if you are pregnant, nursing, taking medication, or have a medical condition. Discontinue use and consult a professional if any adverse reaction occurs. Habituel is not liable for allergic reactions, side effects, or health issues resulting from use or misuse of our products.

SECTION 8 - INDIVIDUAL RESULTS DISCLAIMER

Results vary by individual. Testimonials reflect individual experiences and do not guarantee typical results.

SECTION 9 - COMMUNICATION CONSENT

By purchasing or subscribing, you consent to transactional communications by email (order confirmations, shipping notices, billing reminders, subscription notices). These continue while you have an active order or subscription. Marketing communications are optional and you can unsubscribe from them at any time.

SECTION 10 - INTELLECTUAL PROPERTY

All site content, including text, graphics, logos, product designs, and photos, belongs to Habituel or its licensors. Do not reproduce, distribute, or use it without written permission.

SECTION 11 - USER SUBMISSIONS

If you send us reviews, photos, comments, or suggestions, you grant us the right to use, edit, and publish them without obligation or compensation. Submissions must be yours, accurate, and lawful.

SECTION 12 - PROHIBITED USES

You may not use the site or our products unlawfully, transmit malicious code, scrape data, infringe intellectual property, harass anyone, place fraudulent orders, or attempt to circumvent site security. We may terminate service for violations.

SECTION 13 - THIRD-PARTY LINKS AND TOOLS

Third-party content, links, and tools are provided as-is. We are not responsible for third-party sites or services. Transactions with third parties are between you and them.

SECTION 14 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

The service is provided as-is and as-available, without warranties of any kind. We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, Habituel and its affiliates are not liable for indirect, incidental, or consequential damages. Where liability cannot be excluded, it is limited to the amount you paid for the product giving rise to the claim.

SECTION 15 - INDEMNIFICATION

You agree to indemnify Habituel and its affiliates against claims arising from your breach of these Terms or violation of any law or third-party right.

SECTION 16 - FORCE MAJEURE

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, pandemics, carrier disruptions, labor actions, or government actions.

SECTION 17 - SEVERABILITY, WAIVER, ENTIRE AGREEMENT

If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms plus our posted policies are the entire agreement between you and us.

SECTION 18 - GOVERNING LAW

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of law rules.
